Legal Question in Business Law in New York

small business to incorporate or not

I am starting my own business and would like to know the best choice of legal structure.I want to make sure I have protection from liability without tax penalties.Should I form a corporation or LLC. Someone told me I should file for a business certificate,and set up as a LLC.Any help would be appreciated. Thank you
