Is it illegal to tutor inside the home for payment when you are working part or fulltime for the board of ed in long island?

As I see it, two different rules may be involved: (1) Does your contract prohibit this, if you do it on your own time - this requires review of your contract - and (2) does the Town in which you live have any Ordinances on home businesses - and what is permitted or disallowed? Both issues need to be researched.

Is it illegal, meaning is there a statute or case law in place that makes it illegal to tutor in the home for payment when you are working part- or full-time for the board of education in Long Island? I seriously doubt that such a law/caselaw exists.

I have no idea; this answer would take me much more time and research than is within the purview of this forum.

Would it breach your contract with the Board to tutor in the home for pay? I can only advise you to HAVE A LAWYER REVIEW YOUR CONTRACT WITH THE BOARD OF ED BEFORE YOU START ANY TUTORING. While your proposed tutoring may not be criminally prosecutable, it may indeed constitute a breach of contract, which would make you liable to the Board in civil remedy. Depending on the terms in the contract, a civil remedy could be pretty drastic.
