Legal Question in Civil Rights Law in New York

civil demand

My son took stole a $5 item. He was caught, gave it back, and was released to his Dad (for some serious punishment). Today 2 mos. I got a letter demanding $350.00 or they'll take me to civil court. I guess I am liable for $75, legally but they say I have to pay these extra fees and if they take me to court, I'll have to pay even more. Is this true?

Re: civil demand

First you are not liable for anything, unless you directed your son to steal. Second, if the item was returned unndamaged the letter sounds like extortion. You may want to contact your local DA's office. Third if they take you to court (and I doubt they will) they will need to prove their damages. A strongly worded lawyer's letter may help (but it may cost about as much as they're asking) or you can just ignore the letter, or contact local authorities.

Should you like to discuss this or any other legal matter you can e-mail me for more information about low cost face-to-face, on-line or a telephone consultation with a lawyer in our office.
