Legal Question in Credit and Debt Law in New York

Balance Due

I have been paying on a credit card debt that went to collections. I had been paying the debt but lost track of what my pay schedule was. I contacted them and was told an amount left. With this information I calculated the payments and wrote a letter with that pay schedule to the office. They never responded - and in my letter I wrote that I would take a no response as my pay schedule was correct. Now I am being told that I still have payments left. Do I really owe them since I wrote them a letter w/ no response from them?

Re: Balance Due

you owe what you owe. You can't change it with a letter, even if you put in the letter that if they don't respond your numbers are "correct" they don't have an obligation to respond. They do have an obligation to demonstrate to you why their numbers are correct and why yours are incorrect, if you make a request for (a) an accounting and/or (b) proof the amount is due...If you signed an agreement and you did not make the payments, you should ask for a list of your payments and how they were applied...but you will owe whatever the correct amount is...
