Legal Question in Credit and Debt Law in New York

Check that bounced twice

My wife ran a day care business and when we sold the business one of the fathers gave her a check for the balance he owed. This check bounced twice, I called him sent him emails and spoke to him on the phone once. I gave him two options to pay in full or make payments. He done neither, the worst part is I'm now in CA and his in NY. The second time the check bounced the bank said the account is closed.

Re: Check that bounced twice

You may commence an action both for breach of contract (money due and owing from the day care business) and an action on the bounced check. The action must be commenced in NY since CA has no jurisdiction over the father.
