Do you have to be served legal papers for a legal hold on your bank accounts?

It depends on who has the hold on your bank account. Government may be able to restrain your bank account for back taxes without court judgment while general creditors generally must file suit, serve the debtor and obtain favorable judgment before pursuing a bank restraint. There are many other factors to consider. Additionally, you may be able to vacate a judgment and remove a bank restraint depending on the facts and circumstances of the case.
