Levy on rent

Can i do a third party levy on rent and or mortgage payments to satisfy a debt. What would i need to do in order to take this action.

if you have a judgment against an individual you can attacn (levy) any rent owed to him, and any mortgage payment that is due him. You can also attach his bank accounts, his credit union accounts, his cars ( if there is no money owed on them) etc.

First is that you have to have a judgment and next you must have a lawyer use the correct attachment form, and serve it upon the proper police agency.

To a lawyer, it is a very simple thing to do. But act fast. Once he perceives that you can do this, he will draw his money from the bank and hide his assets.

Remember he must be owed a rent check and a mortgage payment - not paying rent and on a mortgage to precisely answer the question.
