Legal Question in Credit and Debt Law in New York

Medical invoices

Is a spouse required to pay their deceased spouse's medical/hospital bill/co-payment after their spouse died? Invoices are being sent to the estate of deceased - there is no estate. Any assets were transferred to surviving spouse via deceased spouses will.

Re: Medical invoices

If there was a will that was probated, then there WAS an estate. Ideally, bills owed by the deceased would be paid out of the assets in the estate BEFORE they were

distributed.
