Legal Question in Criminal Law in New York

My boyfriend and I were on a dark and private street fooling around quietly, (nothing crazy at all, kissing and some touching) in the backseat with the window covered with a hoodie, just to be sure. Suddenly the cops rolled up, knocked on the window and said someone had called and complained to them. The cop gave both me and my boyfriend a pink summons (violating section 245.01 indecent exposure) and we have a court date for January 28th. The cop directly told us, while laughing it off, that the fine would be between 25-40 dollars and that we would have absolutely no criminal record, and then drove off.

Yet I've been doing research and the fines are ridiculous- 250 dollars?? Criminal records??? Did the cop lie to us? What should I expect when I go to court?

I barely work as I am a full time student and don't have any criminal record. I'm female and 20 years old.

I'm guessing that your summons is returnable to part AR2 on Queens Blvd. Depending on the judge, the initial charge will likely be reduced to an administrative violation with fines in the $50-100 category.

First, don't take legal advice from a cop.

Second, hire a criminal defense lawyer.

I handle pink summons cases all the time.
