Criminal Sale of Controlled Substance NYS- 3rd degree, 2nd offense

My brother was arrested and charged with criminal sale of a controlled substance in the 3rd degree and possession of narcotics. This happened in NYS and he was convicted of a similar crime 8 yrs ago. He went to jail for 1 yr at that time. What will his punishment be?

Your brother would be considered a predicate felon, therefore I believe he faces at least 2-3 years in jail if convicted. I suggest retaining the best possible criminal defense attorney. Consider if he gets 5 years with a non experienced attorney ,but could get 3 years with a competent attorney, he loses possible income for 2 years. What is that worth?
