Legal Question in Criminal Law in New York

Identity Theft

In 2005 my aunt agreed to cosign for my student signature loan, $8,000.I got all her information from her and filled out all the paperwork. We did the signature electronically. Now in 2008, she has filed a police report against me saying i stole her identity and she knew nothing about the loan, which is untrue. She gave me all her information and was aware of all my actions. I spoke with the detective he wants to arrest me. He said i need to turn myself in and go through central booking to see a judge. Is this the correct proceedure. He is treating me like a criminal. I have a degree and a master's degree in Accounting/Finance no less. What should I do?

Re: Identity Theft

You should have your attorney contact the police. You should not contact them yourself and should definitely NOT speak with the police. You have NOTHING to gain by speaking with them.

Re: Identity Theft

You need a lawyer. You should not speak to anyone about this case, unless you have consulted with an attorney. Anything you say to the police can be used against you later on. You should retain an attorney who practices in the area where the charges are being brought against you.
