Possible mistrial?

I was grossly misrepresented at my trial. My lawyer was unprepared and sat on proof that would have helped me. Further, a ploce office who testified, testified that he was the arresting officer and took claim for statements made, he was not the arresting officer and I never spoke to him. My conviction was based on 2 dates that were allowed, one of thsoe dates being the arrest date. The officer, the ADA and a witness all testified to the date of June 12, 2000, my actual arrest date was June 7, 2000. So the judge made a decision on a provable incorrect date. My lawyer refuses to assist me with this, can this be considered a mistrial? A police officer and the witness both lied about my arrest date, which is clearly in the courts database. Help

You do have grounds for a mistrial. You must also provide more information about your case. Was it a jury trial? Do you have the full transcript of your trial?
