Legal Question in Criminal Law in New York

Search of Child by School Principal

My son was accussed of giving drugs to another student. He did in fact give the other student the drugs. Can he be stripped down to his underwear by the school principal and searched? Why wouldn't this be done by the police officer that was in the school building and was called in to speak with my son? He was not arrested but will be expelled for the rest of the school year, which I feel is appropriate. I am not trying to get my son off by any means, he deserves his punishment. I just found this very odd and against policy.

Re: Search of Child by School Principal

The principal is required to follow the procedures set forth by the school board. If he has violated the written procedures, then action may be taken against the principal.

However, no action can be taken on this basis toi advance any interest of your son. The principal is authorized to conduct reasonable searches of students.

Thios is not one that can help your son. Report the matter to the school board by letter.
