Legal Question in DUI Law in New York

Expected Sentencing Advice

My friend has been arrested for his second DWI within 4 years. I do not believe he has a drinking problem but rather believe it is a result of and lack of any place other than a bar where young, single males can socialize. What we do have is more than the required Legislatures, an overabundance of State Police and a larger, newly built county jail. Our community has approx 2000 citizens. What can I friend expect as a result of this second offense? And what should be his defense?

Re: Expected Sentencing Advice

You have not provided enough information to discuss a possible defense. You probably ought not to on a public board like this. Your buddy could be charged with a felony if after his first arrest he pled guilty to a DWI as a misdemeanor. If he pled guilty to a DWAI a violation, then he will be charged with a misdemeanor this time. If charged with a felony, he is facing up to 4 years in prison. If charged with a misdemeanor, he is facing a year in a local jail. (Probably the new one your county just built.)

HE is in desperate need of a real good Criminal defense lawyer. One who knows a lot about DWI's. If you call my office tomorrow I will reccomend someone in your area.

Good Luck to you and your friend.
