Generally it all depends on several factors. Was this his first arrest, first DWI arrest? what was his alleged blood alcohol content? and was there any injury or property damage?

in many instances cases such as these can be challenged based on the stop... on the fact that there may not have been adequate cause to make the stop in the first place, so the arrest would have been improper.
