How Can Bios Sign Over Custody To Grandparents Without Court?

My son & 17 yr old girlfriend had 7 month old grandson taken away for neglect. I tried for custody in court & was proven stable & safe for placement. It was denied & postponed due to hostility between me & Bios. We've been getting along for awhile now & grandson is in Foster Care(3rdFoster home). Now they wish to give us custody. But Bio's lawyer is postponing court till after Xmas. Foster Dad has cancer bad & grandson will be moved again now due to postponement. How can we get custody signed over to us without court? Who do we talk to?

You cannot get custody in this case without the court.You can go back to family court and refile for custody indicating changed circumstances i.e there are hostilities anymore.Since the baby is in foster care however you may contact ACS and request to be made kinship foster parent . If successful you become foster mother.ACS will visit your home to conduct a home study which should not be a problem since your home was found suitable before.
