Legal Question in Family Law in New York

Child custody

My son is recently disabled. He had 50-50 custody of his 4 y3 yr old daughter. Law gaurdian is saying to mom that because Danny can't take care of himself that he is no longer entitled to 50-50 custody. does a person lose their rights when they are disabled and need help caring for themselves? We (danny's dad and mom) were awarded guardianship for danny because he is not capable of handling his own business.

Re: Child custody

You answered your question with the information you provided. If you are his guardians, taking care of him then how is he to take care of a child? He should still have visitation but there may be some limitations given his disability.
