Legal Question in Family Law in New York

Two children 21 and 18

I have two children from my ex-wife, she has custody of my Son who will be 21 in Oct. and I have custody of my Daughter who is 18.

Q: Do I have to go to court to have CS terminated for my Son? And if so, can I also have CS awarded to me for my Daughter, as well as 1/2 of her college expenses etc.

no one has custody of a 21 or an 18 year old. They live where they choose. As for support assuming they are in college then you are entitled to some help from her mom on your daughter. Most good matrimonial agreements terminate support on college graduation or turning 18 whichever comes later. Hence if the child is not attending college you should move to terminate his support.
