child's name change

I am a divorced mother with sole custody of 2 children. I changed back to my maiden name and my children, now with their father's last name, want to change theirs to mine. Their father lives out of state, pays no child support and has nothing to do with them. How can I get their names changed legally? Thank you.

Re: child's name change

To change the childrens name, you will have to go to the Surrogates Court, and get the Surrogate to approve the name change.

About child support: there is no reason why your ex should not pay child support. Just because he lives in a different state should not stop you. Child support has been federalized, to a great extent, and there are many good ways to get an absent parent to pay up.
