Legal Question in Family Law in New York

CUSTODIAL ISSUES for COMMONLAW UNIONS

I have been discussing the possibility of a seperation from my boyfriend of 7 years. We have a child who is 5 years old and who is very dependent on her father emotionally. He is a travelling musician and does not work a full time job when in town. I was looking to sharing equal responsibility of the child and had even prepared a contract that we could work out together reasonably w/out getting involved with the courts. He has threatened that he will leave the country altogether should i go on with a seperation, seeing no other way of resolving the matter. What advice do you give in such a situation? Must I first claim a legal custody over the child and what are my limitations thereafter?

New York does not normally recognize common law marriage. Therefore, the only real issue to be resolved is that of custody and support.
