Divorce in NY

I was married in AZ and left my husband 2/06 and moved back to my home town Rochester, NY. How long will I have to wait to file for a divorce

Hi:

I believe you have to be a resident of NY at least six months to a year before commencing an action for divorce.

If your divorce meets one of the requirements under NY law for a divorce, you can file for a divorce now.

Some of the requirements are: The parties' were married in NY; adultery; abandonment; cruely; and in prison.

NY, however, also requires that you have lived in NY for a period of at least two years before you file for a divorce unless you were married in NY.

It depends on several factors. To meet the residency requirements you have to have lived in NYS for a year and either you were married here, the grounds for divorce arose here or the two of you lived here. Otherwise, you have to have lived in NYS for two years.
