Legal Question in Family Law in New York

legal separation/out of state

I moved to Mississippi from NY city with my 6 yr old child due to spouse abuse. I want a divorce/legal separation ''now'' but don't want to return to NY to do it. Can I do it from MS and not be charged with kidnap or something like that? Or must I return to NY city. Thanks and May God Bless You.

If Mississippi is now your true domicile and you have lived there for the required time you can obtain a Mississippi decree. Speak with an attorney.

If you have lived in MS for 6 months you can petition the courts for a temporary hearing. Contact an attorney for more help.
