Legal Question in Family Law in New York

a loan

Hi, A friend of my mothers had loaned me and my boyfriend $1800.00 and we had payed back $400.00. The man who had loaned us the money suddenly passed away. today his son called me and told me to send him the payments, so my question is do I have to pay his son back since he has passed away?

The loan is still active so yes you have to pay it back. The question is, does his son have authority to collect it on the estates behalf. I would ask the son for papers from the court stating that he is the administrator of his father's estate, or that he is the executor of the will. If he is unable to produce these then ask how is responsible and contact them.

As for the loan itself, I would protect myself in the best way possible. Purchase a money order for the amount due on the loan and use it to establish that you were making payment according to the agreement until you find out to whom they must go.
