Legal Question in Family Law in New York

If something happens to the mother of a child does the father receive rights if he is on the birth certificate, but the child has both parents last names? Although in the mothers will she wants to leave custody to someone else until the father is out of high school.

The father can seek custody of his own child if the mother passes away regardless as to what is in the mother's Last WIll and Testament.
