Obtaining parent's brith certificate

I am the grandson of a now-deceased Holocaust survivor. German law allows me to apply for German citizenship because my paternal grandmother was stripped of hers in the 1930s; however, I need my father's birth certificate in order to prove I am related to my deceased grandmother. My father is aware of the situation but has not been willing to give me permission to request his birth certificate from the New York City Bureau of Vital Statistics. Can I petition a court in New York to order the NYC Bureau of Vital Statistics to allow me to request a copy of my father's birth certificate or otherwise give me permission to request his birth certificate for the sole purpose of applying for German citizenship?

I would first write the NYC agency and

determine whether you could submit an affidavit or simply a letter outlining the reasons underlying your request to acquire a copy of your father's birth certificate in order to avoid having to litigate the matter.
