Parental Rights

I have a daughter who will turn 15 in May and her father has not attempted to visit or contact her since she was 4 years old. Now i hear that he wants to see her and i need to know if he has rights, since he has not choose to see her in 11 years. He has child mandatorially taken out of his disability of 50.00 a month.

Hi:

Simply because your ex did not visit is not in and of itself reason to terminate visitation especially if there is a written settlement agreement.

The answer is yes, his rights were not terminated or relinquished just because he decided not to see them in 11 years. He has the right to petition the court for visitation.
