Legal Question in Family Law in New York

Can they put a restraining order on me?

My girlfriend is 16 and I am 19, we had dated for five months when they found out that we had slept together. Now after a month or two of jockeying they are trying to have a restraining order put on me to keep me from having contact from her. Is it possible for them to have a restraining order against me when she doesn't want it?

Re: Can they put a restraining order on me?

As long as she is under the age of 18 and her parents remain responsible for her, they can pursue a restraining order without their daughter's permission. There may be other legal issues that may be more threatening to you however, the girl is under the age of consent in New York (17 years of age) and you may be liable for sexual misconduct if the realtionship can be proven. You may want to consider removing yourself from the situation, even if only temporarily.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.
