recording telephone conversations

is one parent recording the telephone conversation between their child and the other parent illegal, especially if parents share joint custody?

Re: recording telephone conversations

Under NY law, the recording is illegal unless one party consents to the telephone call. Since a child is not of the age of consent, then the other parent must consent. If the other parent does not consent, then the telephone call is being illegally recorded and may not be used in a court proceeding.
