Legal Question in Family Law in New York

rights of the father to an unborn child

i have a pregnant girlfriend who has been telling me im the father through out 8 months of the pregnancy and i recently found out she had a boyfriend on the side who she is telling the same thing that he is the father. what legal rights do i have as far as the birth certificate goes. Can prevent her from giving the child the other boyfriend's last name on the birth certificate until a paternity test is done? And can i prevent her from allowing him to sign the birth certificate? If not can the birth certificate be changed later with me signing it and the child bearing my last name when i establish paternity?

Re: rights of the father to an unborn child

Q. what legal rights do i have as far as the birth certificate goes.

A. You do not have to sign. If you do sign, you will be deemed the child's father.

Q. Can prevent her from giving the child the other boyfriend's last name on the birth certificate until a paternity test is done?

A. No. But if a paternity test establishes you being the father, the birth certificate will be amended.

Q. And can i prevent her from allowing him to sign the birth certificate?

A. No.

Q. If not can the birth certificate be changed later with me signing it and the child bearing my last name when i establish paternity?

A. Yes, for the reasons set forth above.

Mike.
