Legal Question in Family Law in New York

Separated from wife for six months. She resides with her mother and our 15 month old child in New York. I reside with my parents in Connecticut. We had fled our house in New Jersey due to foreclosure t New York, and eventually separated. No court action at this time.

Am I able to file for visitation orders, or anything involving divorce, in New York state after being out for for several months?

Yes. You may always file with the Family Court for visitation.

You must live in NYS for at least one year before you file for a divorce.

However, you can petition the court in NY for visits.
