Legal Question in Family Law in New York

Separation Agreement Help

My spouse and I have been separated (living apart) for 1.5 years now, and would like an uncontested divorce ASAP. Is there any way for us to expedite or do we still have to file an MSA and wait 1 year?

Re: Separation Agreement Help

Eitheryou or your spouse can start an action for an uncontested divorce on the grounds of abandonment (actual separation without permission from the other spouse) or constructive abandonment (sexual separation without permission from the other spouse) for over a 1-year period.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.
