spousal maintenance and duration

Im going through a divorce. We've been married for 23 yrs and I've been a stay at home parent for 20 yrs and have one child, age 10. My husband said his attorney says I'll only get maintenance for 5 yrs and only $1000 a month..He makes $125,000 a yr and we live in New York..I thought maintenance was decided by a judge?

There are a variety of factors that the Court considers in awarding maintenance. You need to provide more information to get a fair idea of what you might reasonably expect. If an settlement cannot be reached maintenance can be a point decided by a trial or hearing. It certainly is not dictated by an attorney. Are you represented by counsel? If not, you should be. You will do much better than if you try to negotiate yourself.
