Legal Question in Family Law in New York

Is there a way to stop having to pay pre-1980 alimony

Divorced in 1978 in New York State. Still paying $650 monthly alimony.

I am now retired with monthly income limited to about $1100 per month Social Security. My financial assets are primrily taxable IRA's and total about $800,000. Also, currently paying half the cost of college and expenses for two children from a subsequent marriage that also ended in divorce.

Question: Is there any chance, under these circumstance, that I can reduce or eliminate the requred alimony payment from this per-1980 divorce.

Yes, you can bring an Order to Show Cause for a Downward Modification of Alimony.

At least you escaped Equitable Distribution on your first divorce, but I see you came back for a second helping.

I would need to see the Judgment of Divorce before giving you definitive advice.

If you wish to discuss this with me privately, please call to schedule a confidential consultation.

I practice in NYC and Long Island.

You may be able to modify your alimony payments, depending on how the alimony provisions are worded in the divorce documents. Feel free to contact me to discuss your case. I offer a free initial consultation.
