support collection child

when your tax refund is taken for backsupport in ny, and fed. how long does it take to get to the county support unit; and how do you prove it to a judge when you have a hearing and it isnt there yet and if it doesnt show up in 7days you are going to jail. Its been four weeks and the judge wont accept the notice we got from the irs. is there a form or something we can do to prove this has been paid, actually over paid already. we only have seven days.

I would immediately contact the Support Collection Unit and subpoena them to appear in Court with their records. They should have also received notice that your tax refund was seized. Even if the payment has not yet been processed, with the notices that you and SCU received from the IRS coupled with Support Collections records showing that, once the payment is applied, you will have overpaid support, you should be in good shape for the Court appearance.
