Legal Question in Civil Litigation in New York

With a friend who was caught shop lifting

my 17 year old daughter was with a friend who was caught shop lifting. my daughter was not charged with anything. they did not find any merchandise on my daughter. they said my daughter was free to go. the other girl, a 16 year old said some of the stuff was for my daughter. my daughter did not ask her to get anything for her. she asked her to stop. they are pressing charges against the other girl. she has a court date of november 25th. the store sent a civil suit letter through olonoff asen & serebro for $200 to me. my child did not shop lift. why do i have to pay? I have seen on line that they never really sue in these cases because it would cost them more than the $200 to sue, is that true? This has been very upsetting to my daughter. she was in the wrong place at the wrong time. i would like to fight this but won't it cost me more to fight it than to pay. will this be on record any where?

If, in fact, they "never sue" - you have nothing to worry about.

On the other hand, if they do sue, it can get expensive. Hiring a lawyer would certainly cost more than $200.
