liens on case

if there is a lien from a lawsuit funding company on a med mal wrongful death case with the husband being the adm. of estate and suing individually with 2 step daughters, where would the lien be taken from would it be from the husbands personal share in the event of a settlement or would it come from the estate portion of the case in a financial bind now help please

The lien would be on the settlement/trial proceeds of the malpractice case, and would attach to the estate and paid first from the proceeds.
