Legal Question in Civil Litigation in New York

Neighbor's Tree on my house

My neighbor's 115 ft tree fell on my

house and it is now leaning on my

home where my home is holding it

up. It has caused damage etc and

they are a hostile group of people. 1.

Am I allowed to remove the tree

from my property and place it back in

their yard? 2. Can my tree service go

in their yard to remove it from

leaning on my house?

Only 10% of the tree is on my home.

If the tree fell and caused damage to your home, you must first contact your insurance company. After an adjuster inspects and the right to submit a claim is preserved, you can remove the tree from your house. I would suggest having the insurance company make the arrangements.
