Legal Question in Civil Litigation in New York

Personal vs Business

Recently I was offered an informal loan during a time of need from a friend who also happens to purchase equipment from my employer, there was no time frame set on the repayment only when I was financially able. This person has since had a disagreement with my employer and is threatening me that he is deducting the money I owe him from the money he owes my employer and sending them a letter advising of our personal agreement in an attempt to cause me to lose my job do I have any recourse

Re: Personal vs Business

Maybe. The debt is between you and him and has nothing to do with the employer. By demanding payment through the employer, he may be tortiously interfering with your employment agreement. If by his actions he gets you fired, you may have a cause of action against him for tortious intereference of contract.

You must send this individual a letter asking that he cease and desist his actions.

Mike.
