Legal Question in Civil Litigation in New York

Can I sue Compaq?

Hello

I bought a Compaq notebook in September 2000 when I was on a Fulbright Fellowship to the US from India. It got replaced on two occasions - for malfunctioning and giving shocks. The last replacement was done in March 2001. I came back to India for a short trip in December 2002. The keyboard stopped working around then. I was told by Compaq India that I have to replace the 'system board' itself, which virtually amounts to buying a new laptop/notebook, for the system board costs about 1500 USD in India.

As it happens the product (Armada E500) is out of warranty. Effectively, within the space of 28 months or so, all three Compaq notebooks that I bought/exchanged turned out to be faulty.

Compaq India has been lax in responding, and it seems since the product was bought and exchanged in the US on all occasions, the consumer court in India cannot fight for me here.

Question is: can I actually fight a case against Compaq for all this?

Needless to say, I will be happy to share any information with you regarding this.

Regards and best wishes,

Re: Can I sue Compaq?

Since you bought the product in U.S.A., the applicability of laws of India will be doubtful, unless terms of warranty so provide specifically.

In any case, there must be a remedy under the law of U.S.A. for such things. Please check. You may post a new question specifically requesting lawguru to host it and send it to attorneys in U.S.A.
