Legal Question in Immigration Law in New York

Child citizenship

My ex-girlfriend, a Venezuelan woman, has a daughter who is almost certainly mine. However, there is no information on her birth certificate about the father. Is the daughter eligible for U.S. citizenship?

Re: Child citizenship

It depends. Are you a US citizen? Do you have custody of your daughter? Have you been recognized as her father? Where does she live and where was she born?

She may have obtained citizenship at birth.

Re: Child citizenship

If she was born in USA, then she is eligible by birth. If she was born outside USA, and you can establish paternity, then she might be eligible if you are a U.S. citizen.

Re: Child citizenship

Assuming it is a Birth Abroad Out-of-Wedlock to a U.S. Citizen Father, then

A child may be eligible to acquire U.S Citizenship provided there is a clear and convincing proof of a blood relationship; you had U.S citizenship at the time of childs birth; you had agreed in writing to provide a financial support for a person until child reaches age of 18; before a child turned 18 - you acknowledged paternity in writing OR you paternity is established by adjudication court OR child is legitimated by the law of his residence.
