Greencard through marriage

I was a student with F-1 visa when I married my US citizen . We've been married for 6 years, but never filed for my greencard because he did not have a steady job, and we didn't have a sponsor. So, I 've been out of states for the last 5 years or so. We are technically still married but have been separated for about 3 years , and I still don't have a states. Now I have a boyfriend who loves me wants to marry me. In order to stay in the US, what the best course to take. Do I divorce my husband first and become illegal, then marry my boyfriend and apply for a states? Or I should somehow file the paper with my husband first, then divorce him? I would greatly appreciate any advice. Thank you.

Right now you are still out of status and subject to deportation at any time. You will need to (1) immediately divorce your husband, (2) marry your new boyfriend, and (3) start the green card process immediately. Until you do number 3, you are out of status and in danger. If your current boyfriend is a US citizen, you can divorce your husband, marry your boy friend and apply for green card. Contact our firm if you have more questions.

You'll want to get a divorce, re-marry your boyfriend, then apply for permanent residence through your new husband.
