Legal Question in Immigration Law in New York

k-1 visa

I am planning to start the k-1 visa process with my fiance. She was married to an american before and living in the US. They are now divorced. Is there any documentation we need for the new visa process concering her prior visa status? I am meaning any papers other than the divorce decree to show that the prior visa no longer exists.

What visa did she enter the US with?

She will have to provide her passport to immigration.

When she was married to the American did she file any immigration papers?

She will, of course, have to provide all the documents she had submitted before as requested.

Yes, you would need to submit the prior divorce decree as well as all the other required documentation for the application. It is imperative to understand if there were any circumstances that could trigger a bar due to her prior stay in the U.S. that would affect this K-1 visa application.

It is advisable that you at least consult with an attorney prior to filing.
