Legal Question in Immigration Law in New York

i paid a lawyer to file for a work visa with the dept of labor and my lawyer won

i paid a lawyer 3 years ago to process a work visa application with the dept of labor. i asked my lawyer for proof that the dept of labor received the paperwork and he said there is no way to know just to wait. does the dept of labor give attorneys a receipt confirmation when paperwork is filed. i think he is lying and never submitted my paperwork. how can i prove it?

The department of Labor does acknowledge the receipt of applications. So there is a way of knowing if the application arrived to the Department. However, the lack of a receipt does not necessarily mean that the application was never filed. Your attorney might have sent the application and it might have been misplaced somewhere along the way. However, he should have followed up on it when he saw that there was no answer from the DOL.

I suggest you tell your attorney what your concerns are. Look at the retainer or any papers you signed when you hired him. What was he supposed to do for you? The receipt for the money you paid is also an indication of the services that you contracted for.
