Legal Question in Immigration Law in New York

Will he get deported if marrying a US Citizen?

My friend is in the US without a legal status. He is marrying a girl who is a US citizen. He is afraid to go to City Hall since he was told they contact officials and get him deported. Can this be true?

That's a new one to me. I have seen people detained after accepting an invitation to 26 Federal Plaza or other USCIS offices in the circumstances where they were deportable but the City Hall is unlikely to be able to tell whether your friend is lacking legal immigration status since none is needed to get married.

Depending on what you mean "without a legal status," of course, your friend may or may not be successful in adjusting his status to that of LPR and should contact an immigration attorney.

The above reply is in the nature of general information, is not legal advice and should not be relied on as such.

It is not very likely that the officials at the City Hall would "report" him. By marrying a US citizen, your friend may be able to adjust his status to that of a lawful permanent resident. I am currently handling a few cases with a similar fact pattern.
