Legal Question in Employment Law in New York

Independent contractors

I work as a Exotic entertainer, hired as an independent contractor. The owner of the club states that on his copy(which he doesn't give a copy to the dancers) that we have to follow the house rules governed by the house, BUT there are no rules listed. Sanctions are fines for lateness and no shows from $50-$150 a day! IF thie rules are not stated on the contract is it still binding, are these ''fines'' legal?

Re: Independent contractors

You should be given a copy of your contract. You should also not pay the fine or work at this club. Even the issue of whether you are independant contractors are up in the air in reality. You should see a lawyer about this. I have represented many people in the industry and would be willing to discuss your situation with you. You may contact me through the links below.

Good Luck.

Re: Independent contractors

Many times employers try to classify people as independent contractors when they are in reality employees who have a number of additional rights. In terms of the fines you should have been provided a copy of rules to which you are required to adhere. You should retain a lawyer to review the contract you signed. You are entitled to a copy of the agreement that you signed. Please feel free to contact my firm if we can be of any assistance in this matter.
