Legal Question in Employment Law in New York

Layoffs and rehiring

After being laid off my employer called and asked me if I would be interested in coming back. Then made me interview for my job again. Can they do that?

Re: Layoffs and rehiring

They can do that. More importantly, what are you doing to ensure that it won't happen again and that if it does, you will be adequately compensated? Furthermore, if you signed a severance agreement and were compensated upon your departure, you need to check the agreement to see if the prior severance payment will be mitigated upon being re-hired by the company (a standard severance clause).
