Legal Question in Employment Law in New York

Non Compete

If I have signed a generic non-compete for my employer in the early part of this year and they requested that I sign along with all my peers to sign a new one that is more curtailed and has a time limit on it since the last was left indefinately, and I was terminated without cause in NY State prior to signing it, does the original non compete stay enforceable. They have basically removed my right and ability to work and make a living. This seems to be a buly tactic that has removed my livelihood. The cursory calls I have made state a lawyer will cost me over $10k to fight or bring to court, that is a huge gulp for a gamble and no income to pay for. Sort of a catch 22, any ideas, the company will not speak to me directly anymore.

Re: Non Compete

You need to retain an attorney in a situation like this, so that the company will take you seriously. The amount you were quoted was probably for litigation. However, it is possible the company will be willing to settle this issue with you in order to avoid litigation. Please feel free to contact my office if we can be of any assistance to you.

Re: Non Compete

Depending on the exact circumstances of your dismissal, there are several options for you. I agree that $10,000 is an excessive amount to pay for an attorney.

I am experienced in handling severance cases (severanceattorney.com) and may be able to offer you some guidance on moving forward at this point.

You may contact me via email to arrange for a consultation.
