Legal Question in Employment Law in New York

Part-time vs. Temporary Employee

My company is downsizing and no longer require my services. I was working part-time, about 20 hours a week, for the last 2 years. They are offering severance to part-time employees but have denied me, claiming I am a temporary employee. What is the distinction? I handed in a time card each week, I did not receive medical benefits but they were contributing to my 401K. I am a former FT employee there. I had no contract and no end date.

Re: Part-time vs. Temporary Employee

Depending on how long you were a F/T employee, I could see situations in which you should be entitled to severance pay.

First, check the employee handbook to see if the company has a severance policy (i.e. 1 week per year).
