Legal Question in Employment Law in New York

Does Salaried mean 24x7?

Our company requires us to work 40+ hours per week and then approximately 1 weekend per month carry a pager for customer calls. There are times these calls can take up an entire weekend and there is no compensation. Can they require me to work at all hours?

It depends upon whether under the Fair Labor Standards Act, your job is classified as EXEMPT or NON-EXEMPT. If your job is NON-EXEMPT, as most hourly jobs are, you are entitled to overtime compensation. Even if your job is salaried, you could still be entitled to overtime. Employers frequently misclassify employees and the penalties for employers can be substantial. You can contact my office through FLSAattorney.com for a complimentary telephone conversation.
