Legal Question in Employment Law in New York

wrongful termination ?

i was an attorney dating a paralegal, but had no supervisory role over her. our employer fired us both, claiming it violated company policy. however, there was no such company policy prohibiting this conduct. Do I have a claim against my former employer ?

Re: wrongful termination ?

As you know, most employment is at will, however under certain circumstances it may be possible to file a suit.

Overall, if there is no policy against the action and the facts are as you say, there very well may be a claim... furhtermore, depending on your contract - which will without question play a large role - this action may be more permissible or even barred...

the old law school answer of 'it depends' truly rules this case, please contact our office for a more thorough FREE phone consultation... you may reach us at 212.709.8303
